These Terms govern your use of DonaldXLRobertson.com and your purchase of placements and related services from DonaldXLRobertson.com (“we,” “us,” “our”). By booking a placement or using the site, you agree to these Terms.
1) Services
We offer promotional placements including (but not limited to) Artist Spotlight, New This Week, Playlist Marketplace, and Video placements. Availability is first come, first served. Duration and inclusions are shown on each product page.
2) Editorial discretion
We may approve, decline, edit, or remove submissions at our discretion (e.g., quality issues, inappropriate or unlawful content).
3) Content requirements & license
You represent and warrant that you have all rights necessary to submit your music, images, and text, and that your content does not infringe rights or violate law. You grant us a non-exclusive, royalty-free license to display your submitted content on our site, playlists, emails, and promotional materials solely to provide the purchased placement.
4) No guarantees
Placements provide exposure only. We do not guarantee streams, views, sales, followers, charting, or specific outcomes.
5) Pricing & payment
Prices are listed on the site. Payment is due in full to secure a slot. All sales are final and non-refundable once a placement is confirmed. Taxes/fees from payment processors may apply.
6) Scheduling & changes
We’ll confirm the start date after payment. Requested changes or rescheduling are not guaranteed and depend on availability.
7) Playlist Marketplace specifics
For Marketplace placements managed by us, the fee is per song per playlist for the stated duration. Optional upgrades (e.g., cover feature) are limited and first come, first served.
8) Prohibited content
No hate speech, illegal content, spam/bot activity, explicit harassment, or materials that violate platform terms (e.g., Spotify/Apple Music policies).
9) Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount you paid for the specific placement giving rise to the claim.
10) Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content or breach of these Terms.
11) Intellectual property
Site content, branding, and materials are owned by us or our licensors and may not be used without permission.
12) Governing law
These Terms are governed by the laws of Texas, USA (without regard to conflicts of law). Venue for disputes lies in Texas courts.
13) Changes to Terms
We may update these Terms at any time. Continued use after changes means you accept the updated Terms.
